Terms and Conditions for EdukaiMe

Please read these Terms and Conditions ('Terms', 'T&C') carefully before using the EdukaiMe web application ('the App') operated by EdukaiMe ('us', 'we', or 'our').

Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the App.

By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the App.

1. Services

EdukaiMe is a web application that uses AI to assist students in their studies. The App generates abstracts, summaries, and mock questions of varying difficulties based on user-provided content.

2. Account Plans and Pricing

EdukaiMe offers the following account plans:

a) Free Plan:
   - 15 credits per month
   - 1 AI Tutor
   - Maximum file upload size: 250 KB
   - Price: US$ 0.00

b) Smart Plan:
   - 150 credits per month
   - 5 AI Tutors
   - Maximum file upload size: 5 MB
   - Price: US$ 5.97 per month

c) Nerd Plan:
   - 350 credits per month
   - Unlimited AI Tutors
   - Maximum file upload size: 50 MB
   - Price: US$ 12.97 per month

Additional credits can be purchased at a rate of US$ 2.29 per 50 credits.

3. Payments and Refunds

3.1. All payments are processed through Stripe, our third-party payment gateway. Users are subject to Stripe's Terms of Service and Privacy Policy.

3.2. Refunds are available within 7 days of purchase, provided that no credits have been used. To request a refund, please contact our support team at support@edukai.me.

4. User Eligibility

4.1. EdukaiMe is available to users of all ages, provided they can operate a computer and are of study age.

4.2. By using the App, you represent that you have the legal capacity to enter into these Terms.

5. Availability and Language

5.1. EdukaiMe is available worldwide.

5.2. The App is currently available in English and Portuguese (Brazil) only.

6. User Content and Data

6.1. Users are prohibited from uploading any text files that violate local laws or Brazilian laws.

6.2. Tables of Contents from user files are stored in our database as part of the App's functionality.

6.3. User documents are processed using OpenAI's API to generate content and create AI Assistants.

6.4. Files are uploaded to Amazon S3 for storage.

7. Intellectual Property

7.1. The App and its original content, features, and functionality are owned by EdukaiMe and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

8. Prohibited Uses

Users are strictly prohibited from:

8.1. Attempting to cheat, hack, or otherwise interfere with the App's functionality.

8.2. Using the App for any illegal purposes or in violation of any local, state, national, or international law.

8.3. Transmitting any material that is defamatory, offensive, or otherwise objectionable.

Violation of these prohibitions may result in immediate termination of your account and potential reporting to relevant authorities.

9. Account Termination and Data Retention

9.1. When a user's paid plan is cancelled or expires, all user's AI Tutors (except the last one created), associated Tables of Contents, OpenAI Assistants, and uploaded files will be deleted after 14 days.

9.2. Users will receive an email notification 3 days before the deletion process, with the option to prevent deletion by upgrading their plan.

9.3. Users may request account deletion at any time by contacting support. The refund policy applies in this situation.

10. Limitation of Liability

To the maximum extent permitted by law, EdukaiMe shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

10.1. Your access to or use of or inability to access or use the App.

10.2. Any conduct or content of any third party on the App.

10.3. Any content obtained from the App.

10.4. Unauthorized access, use, or alteration of your transmissions or content.

11. Disclaimer

11.1. Your use of the App is at your sole risk. The App is provided on an 'AS IS' and 'AS AVAILABLE' basis.

11.2. EdukaiMe does not warrant that the results that may be obtained from the use of the App will be accurate or reliable.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
